Terms And Conditions Of Sale

1. Definitions

“The Healing Pages Angela Gorman,
(we, us, our)”: trading as The Healing Pages
46 Walnut Rise
Drumcondra, Dublin 9

“The customer, (you)”: The person or company buying The Healing Pages or third party merchandise, seminars or services, available for sale on thehealingpages.com website.

“Product”: The products and services described in the order confirmation, which may included third party products, seminars and service offerings.

2. Terms of Sale

The display of the Product on this website does not constitute an offer to sell the products described or any products at all. In the event that you wish to make an offer to buy a product, you do so by clicking the Submit button and by doing so you will be submitting an order to the Healing Pages which will incorporate this agreement.

In the event that the Healing Pages elect to accept your offer you will be so advised by the Healing Pages. The Healing Pages reserves the right to accept the whole or part of any order (whether in respect of the type of Product ordered or the amount) at its sole discretion and in such instance, the price will be reduced accordingly. The Healing Pages will notify you by e-mail when your order has been accepted and your credit card will be debited accordingly after accepting the order. An invalid credit card will result in an error message and you will not be allowed to proceed with the order.

3. Availability of Product

The Product described on the website is only available to persons in the European Union and the United States of America.

In the event of the Product ordered and such order being accepted by us, we reserve the right to notify you at any time before delivery of the unavailability of the particular product ordered and the right to cancel this contract and refund you all money paid in full and/or in the alternative offer you with equivalent products instead.

4. Orders/Contract

Orders are accepted by internet and telephone but are only binding when accepted by the Healing Pages and when the Healing Pages provides an order confirmation in writing by email. Please check the order confirmation and notify the Healing Pages of any mistake by email or telephone immediately, otherwise the details stated in the order confirmation will apply to this agreement.

5. Price Containment Terms

Quotations are only valid during the period that they state. If unstated, the period is 30 days from the date stated in the quotation. The Healing Pages reserves the right to change the Products at any time. Price quotations are inclusive of VAT but not delivery costs.

In the case of the supply of books, periodicals or other goods, payment will be made before the supply of the ordered goods, by way of credit card only.

In the case of the supply of any services, payment may be effected by printing out the order form http://www.thehealingpages.com/Workshops/Schedules/RegistrationForm.html, and sending same together with a cheque in respect of the appropriate amount to: The Healing Pages – 46 Walnut Rise, Drumcondra, Dublin 9, or by credit card.

6. Delivery/Title/Risk

The place of delivery is stated in the Order Confirmation. Title to ordered goods passes on full payment. If you refuse delivery without the agreement of the Healing Pages, you must pay the Healing Pages costs, loss or expenses resulting from that refusal, until you accept delivery.

We will deliver the Product to the delivery address specified in your order. Products will not be dispatched until we have cleared funds. If we make two failed attempts to deliver your product, we will notify you and thereafter you will be responsible for making your own arrangements to accept delivery of the Product at your own cost.

7. Cooling Off Period For Products and Goods

If you wish for any reason to cancel your order and return the Product delivered, the Product must be in its original condition with packaging, a return note and proof of purchase. You will be obliged to bear the direct cost of returning the Product to us. No refund will be forthcoming until the Product is returned to us and in any event no refund will be forthcoming if the Product is not received by us within 30 days of you notifying us of your intention to return the Product.

8. Seminar / Workshop Cancellation, Transfer & Refund Policy

The Healing Pages has a Non Refundable policy for seminars and workshops. If a registration is cancelled by the customer no refund will be issued. The customer however may choose to transfer their tuition to another scheduled seminar.

The customer must notify The Healing Pages by phone, email or in writing prior to start of seminar to be eligible for a transfer. If the customer doesn’t attend the seminar and has not notified The Healing Pages prior to the start of the seminar, they will not be eligible to transfer their tuition to a future seminar. It is the customers responsibility to make sure that The Healing Pages receives notice of non attendance prior to the seminar.

The Healing Pages reserves the right to cancel a seminar due to low attendance or unforeseen circumstances. In the event that a seminar is cancelled by The Healing Pages, we will refund the full amount paid or registrants can choose to transfer tuition to another scheduled seminar. The Healing Pages is not responsible for other charges incurred by the registrant, including hotel, travel fees, etc.
The Healing Pages reserves the right to alter the course location and date at any time without liability.

9. Liability

All goods supplied by the Healing Pages are warranted to be of sound workmanship and materials and suitable for the purpose for which they are designed under fair conditions. The Healing Pages liability will be limited to the replacement, free repair or issue of credit against any goods acknowledged by us to be faulty, provided that such faults have not been caused by your misuse of the goods or your negligent handling of them.

However, the customer should inspect the goods within 48 hours of receipt and advise the Healing Pages in writing/by fax/e-mail of any defect in material or workmanship. If no report is received in this time period the customer will be deemed fully to have accepted the delivery.

In no circumstances will the Healing Pages be responsible for any indirect, special, incidental or consequential damages of any kind regardless of the form of action whether in contract, tort or otherwise resulting from any alleged or perceived defect in the goods supplied.

10. Force Majeure

The Healing Pages is not liable for delays in performance (including delivery or service) caused by circumstances beyond its reasonable control and will be entitled to a time extension for performance; examples include strikes, suppliers/transport/production problems including without limitation, industrial relations problems, exchange fluctuations, governmental or regulatory reaction and natural disasters. If such lasts for more than 2 months, this agreement may be terminated by either party without compensation.

11. Jurisdiction

The parties hereby agree that any dispute whatsoever arising out of the supply of products to the customer will be subject to Irish law and the exclusive jurisdiction of the courts of the Republic of Ireland. The Vienna Convention on contracts of the international sale of goods is excluded in its entirety.

12. Severance

If any part of this agreement is found to be invalid or unenforceable by a court or other competent authority to be void or unenforceable such a provision shall be deemed to be deleted. The remaining provisions of the terms and conditions shall continue in full force and effect.

13. Entire Agreement

This Agreement expressly incorporates the Healing Pages Privacy Policy http://www.thehealingpages.com/LegalDocs/PrivacyPolicy.html and the Healing Pages Terms and Conditions of Use http://www.thehealingpages.com/LegalDocs/TermsAndConditions.html and together with these Terms and Conditions of Sale, they contain the entire understanding and agreement between the Healing Pages and the Customer relating to the sale of products to the Customer through the site.

I hereby wish to purchase the products ordered and hereby acknowledge and confirm that I have read the Healing Pages Terms and Conditions of Sale, the Healing Pages Privacy Policy and the Healing Pages Terms and Conditions of Use and confirm that I hereby agree to purchase the Product ordered on the basis of the terms contained in the documents mentioned above.
